What does it mean for buildings?

Under Local Law 97, building owners are required to meet certain emissions intensity limits, measured in carbon dioxide equivalent (CO2e) per square foot. Local Law 97 sets its limits based on ENERGY STAR Porfolio Management tool. The emissions limits are set to take effect in 2024 and will become progressively stricter over time, with reductions required by 2030, 2035, and 2050. Building owners who fail to meet the carbon emissions caps will face significant fines.

Local Law 97 targets:

- Buildings that exceed 25,000 gross square feet;

- Two or more buildings on the same tax lot that together exceed 50,000 square feet;

- Two or more buildings owned by a condo association that are governed by the same board of managers and that together exceed 50,000 square feet.

Concretely, the law impacts nearly 60% of the city’s building area (including 59% residential and 41% commercial). So far, many buildings are significantly above emissions limits.

To comply with Local Law 97, building owners have several options. They can improve energy efficiency, retrofit their buildings, adopt renewable energy sources, or purchase carbon offsets. The law also provides incentives and financing programs to help building owners implement the necessary changes.
